2023 AND 2024 ANNUAL REPORT CUTLER FARMS METROPOLITAN DISTRICT
As required by Section 32-1-207(3)(c), C.R.S., Section VI of the District’s Service Plan, and Section 13-4001(c)(2) of the Commerce City Revised Municipal Code, the following report of the activities of Cutler Farms Metropolitan District (the “District”) from January 1, 2023 to December 31, 2024 is hereby submitted to the City of Commerce City (the “City”).
A. Boundary changes made or proposed: None.
B. Intergovernmental Agreements entered into, proposed, or terminated: None.
C. Access information to obtain a copy of rules and regulations adopted: The District has not adopted any rules of regulations to date.
D. Summary of litigation involving the District’s public improvements: To our knowledge, the District is not engaged in any litigation.
E. Status of the District’s construction of public improvements: The District did not construct or acquire any improvements in 2023 or 2024.
F. Conveyances or dedications of facilities or improvements, constructed by the District, to the City: None.
G. Final assessed valuation of the District for the reporting year: 2023: $1,899,770
2024: $27,000
H. Current year’s budget, including a description of the public improvements to be constructed by the District in such year : Copies of the District’s 2024 and 2025 budgets are attached hereto:

The District has no current plans to acquire or construct improvements in 2025, however, that is subject to change as market conditions dictate. The District will continue to conduct its affairs in accordance with the 2025 budget.
I. Audited financial statements for the reporting year (or application for exemption from audit): The District is currently exempt from audit, pursuant to Section 29-1-604, C.R.S. A copy of the 2023 Application for Exemption from Audit is attached hereto:

The 2024 Application for Exemption from Audit will be provided when available.
J. Notice of any uncured events of default by the District, which continue beyond a ninety (90) day period, under any debt instrument: To our knowledge, there are no uncured events of default by the District which continue beyond a ninety (90) day period.
K. Any inability of the District to pay its obligations as they come due, in accordance with the terms of such obligations, which continues beyond a ninety (90) day period: To our knowledge, the District has been able to pay its obligations as they come due.
L. Changes or proposed changes in the District’s policies: There were no changes or
proposed changes in the District’s policies.
M. Changes or proposed changes in the District’s operations: There were no changes
or proposed changes in the District’s operations.
N. Any changes in the financial status of the District including revenue projections, or operating costs: The current status of the financial condition of the District is reflected in the 2025 budget, attached hereto:

O. Proposed plans for the year immediately following the year summarized in the annual report: The District has no current plans to acquire or construct improvements in 2026, however, that is subject to change as market conditions dictate. The District will continue to conduct its affairs in accordance with the 2025 budget.
P. A narrative summary of the progress of the district in implementing its service plan for the report year: The District is in development stage.
Q. Unless disclosed within a separate schedule to the financial statements, a summary of the capital expenditures incurred by the district in development of improvements in the report year: See the 2024 and 2025 Budgets posted above.
R. Unless disclosed within a separate schedule to the financial statements, a summary of financial obligations of the district at the end of the report year, including the amount of outstanding debt, the amount and terms of any new district debt issued in the report year, the total assessed valuation of all taxable property within the district's boundaries as of January 1 of the report year and the current total district mill levy pledged to debt retirement in the report year: See the 2024 and 2025 Budgets posted above.
